  • General Provisions
    • These Terms of Use define the rules for using the Swepzy mobile application (“Application”), operated by itworked (Tax ID: 123456789).
    • Using the Application means accepting these Terms and the Privacy Policy.
    • The Application connects people seeking cleaning services (“Client”) with those offering such services (“Contractor”).
    • The Application operator acts as an intermediary – it does not provide cleaning services nor is a party to any agreements between users.
    • The Application is available in both mobile (PWA) and browser (web) versions.
    • The Operator is not responsible for the quality of services performed or for any damage caused during their execution.
  • Registration and User Account
    • Registration in the Application is required to use its features and is only available to adults (18+).
    • Users can create an account as a Client or Contractor by providing contact details and location.
    • Registration requires acceptance of the Terms and the Privacy Policy.
    • The Operator may suspend or delete an account in case of a breach of the Terms.
    • Users may request deletion of their account and data by contacting the Operator at info@swepzy.com.
  • Platform Rules
    • Clients can post cleaning offers by specifying location (map point), scope, date, and proposed rate.
    • History, location, status, and details of orders are stored by the Operator to ensure application functionality and handle complaints.
    • Contractors can view available jobs, accept them, and perform within the specified timeframe.
    • Users have access to the history and statuses of their orders.
    • After the service is completed, the Client confirms the completion.
  • Payments and Fees
    • All payments in the Application are handled exclusively through Stripe (Stripe Connect Express).
    • Swepzy does not have access to users’ bank or card data.
    • Bank details are managed through a secure Stripe panel.
    • Deleting Stripe data is only possible by contacting Stripe directly.
    • The Application does not store payment card data.
    • Swepzy charges a commission from both parties – the amount is shown in the app before confirming the order or accepting the offer.
  • Rights and Responsibilities of Users
    • The Client is responsible for providing access to the property and confirming the service on time.
    • The Contractor is obliged to perform the service diligently and according to the offer description.
    • Users may not bypass the Application to avoid commission fees.
    • Swepzy is not liable for actions, omissions, damages, delays, or non-performance of services.
    • Swepzy is not a party to the agreement between the Client and the Contractor. Responsibility for quality, scope, and consequences lies solely with the Users.
    • Users must not use the Application for illegal or unethical activities.
  • Personal Data Protection (GDPR)
    • The data controller is itworked.
    • Data is processed for the purpose of providing services, billing, and communication between users.
    • Users have the right to access, edit, and delete their personal data.
    • Details are described in the Privacy Policy and in accordance with the GDPR (Regulation 2016/679).
  • Complaints
    • Complaints only apply to orders and payments processed through the Application.
    • Complaints should be submitted via the Application or by email: info@swepzy.com.
    • The Operator reviews complaints within 14 business days.
    • The Operator does not resolve disputes between Clients and Contractors but may support clarification at its discretion.
  • Changes to the Terms
    • The Operator reserves the right to modify the Terms with prior notice to users.
    • Changes take effect 14 days after being published in the Application.
  • Governing Law
    • These Terms and the use of the Application are governed by Polish law.
    • All disputes shall be resolved by the competent Polish court in accordance with the Civil Code.
